These Terms and Conditions (“Terms”) govern all services provided by Picasso Painting LLC (“Company,” “Contractor,” “we,” “us,” or “our”) and the use of our website. By accepting an estimate, signing a contract, or allowing work to begin, the homeowner or client (“Client,” “you,” or “your”) agrees to these Terms.
1. COMPANY INFORMATION
Business Name: Picasso Painting LLC
Service Area: New Jersey
Services Offered: Residential and commercial painting, including but not limited to interior painting, exterior painting, cabinet painting, epoxy floor coatings, surface preparation, and related services.
Registration does not constitute endorsement by the State of New Jersey.
2. SCOPE OF WORK
All work performed by Picasso Painting LLC is limited strictly to the scope described in the written estimate, proposal, or contract approved by the Client.

Any work not specifically listed is excluded.

Additional work requested by the Client will require a written change order and may result in additional charges and time.
Verbal agreements are not valid under NJ contractor law.
3. ESTIMATES, PRICING & UNFORESEEN CONDITIONS

Estimates are based on visible and accessible conditions at the time of inspection.

Hidden or unforeseen conditions (including but not limited to water damage, rot, mold, structural defects, insect damage, lead paint, or asbestos) are not included.

If such conditions are discovered, work may stop until a written Change Order is approved.
4. DEPOSITS & PAYMENT TERMS (NJ COMPLIANT)

Deposits shall not exceed the amount permitted by NJ law.
-
Progress payments may be required depending on project size.
-
Final payment is due upon substantial completion unless otherwise stated in writing.
Late or unpaid balances may result in:

Suspension of work
-
Collection costs
-
Attorney fees and court costs as permitted by law
5. THREE-DAY RIGHT TO CANCEL (MANDATORY – NJ)
You may cancel this contract within three (3) business days from the date of signing, without penalty or obligation, as provided by New Jersey law.

Cancellation must be in writing.

After the 3-day period, deposits may become non-refundable if materials are ordered or labor is scheduled.
6. CLIENT RESPONSIBILITIES
The Client agrees to:

Provide safe, unobstructed access to work areas
-
Remove valuables, breakables, and personal items
-
Secure pets and children away from work zones
-
Ensure utilities (electricity, water) are available
-
Disclose known hazards or prior repairs
Picasso Painting is not responsible for delays or damages resulting from failure to meet these responsibilities.
7. PERMITS & CODE COMPLIANCE

Unless expressly stated, permits are not included.
-
Where required, permits will be obtained in accordance with local NJ codes.

Work is performed to generally accepted industry standards but Picasso Painting is not responsible for pre-existing code violations.
8. MATERIALS, COLORS & FINISHES
-
Client-approved colors and finishes are final.
-
Color variations may occur due to lighting, surface texture, and previous coatings.
-
Touch-ups may not perfectly match surrounding areas due to curing, fading, or environmental exposure.
9. SURFACE CONDITIONS & PAINT PERFORMANCE
Paint performance depends on existing surface conditions. Picasso Painting is not responsible for failures caused by:

Moisture intrusion or leaks
-
Structural movement or settling
-
Inferior previous coatings
-
Environmental conditions beyond our control
10. LEAD PAINT & HAZARDOUS MATERIALS (EPA/NJ)
-
Homes built before 1978 may contain lead-based paint.
-
Picasso Painting LLC does not test for lead, asbestos, or hazardous materials unless specifically contracted.
-
Discovery of hazardous materials may require work stoppage and third-party remediation at the Client’s expense.
11. WARRANTY (LIMITED – NJ)
-
Picasso Painting LLC provides a limited workmanship warranty as stated in the contract.

Warranty excludes:
-
Normal wear and tear
-
Water or moisture damage
-
Mold or mildew
-
Acts of God
-
Abuse or improper maintenance
-
Work altered by others
-
Warranty is void if balance is unpaid or if third parties modify the work.
12. PROPERTY DAMAGE DISCLAIMER
While reasonable care is taken, minor incidental damage may occur. Picasso Painting LLC is not liable for:

Pre-existing defects
-
Hairline cracks
-
Nail pops
-
Wood expansion/contraction
-
Normal settlement issues common in NJ homes
13. MECHANICS’ LIEN RIGHTS (NJ NOTICE)
Under New Jersey law, Picasso Painting LLC reserves the right to file a Construction Lien for unpaid labor or materials, in accordance with the New Jersey Construction Lien Law (N.J.S.A. 2A:44A).
14. LIMITATION OF LIABILITY
To the fullest extent permitted by NJ law:

Liability is limited to the amount paid for services.

Picasso Painting LLC is not liable for indirect, incidental, or consequential damages.

Client agrees to indemnify and hold harmless Picasso Painting LLC from claims arising from Client negligence or misrepresentation.
15. DELAYS & FORCE MAJEURE
Picasso Painting LLC is not responsible for delays caused by:

Weather conditions
-
Material shortages
-
Acts of God
-
Government orders
-
Client changes or inaction
Project timelines are estimates only.
16. PHOTOGRAPHY & MARKETING RIGHTS
Client grants permission to photograph completed work for marketing purposes (website, portfolio, social media). No personal identifying information will be disclosed.
17. WEBSITE TERMS & INTELLECTUAL PROPERTY
All website content is owned by Picasso Painting LLC and may not be copied or reproduced without written consent.
18. DISPUTE RESOLUTION & GOVERNING LAW

Parties agree to attempt good-faith resolution first.

These Terms are governed by the laws of the State of New Jersey.

Venue shall be a court of competent jurisdiction in New Jersey.
19. TERMINATION OF CONTRACT
Picasso Painting LLC may terminate the agreement if:

Payment is not made
-
Unsafe working conditions exist
-
Client breaches these Terms
Client remains responsible for work completed and materials ordered.
20. SEVERABILITY
If any provision is deemed unenforceable, the remaining provisions shall remain in full force.
21. ENTIRE AGREEMENT
This document, together with the signed estimate or contract, constitutes the entire agreement between the parties.
